Your questions, our answers. Electric charging stations in co-ownerships: what are the installation procedures?

You have two options: installing a personal terminal in your parking space in the condominium (installation at your expense), or installing several terminals that will benefit the entire condominium.

• In the first case, you alone (as the applicant) must inform your trustee of your intention, by registered letter with acknowledgment of receipt.

To this end, you will need to attach a file including:

- A detailed description of the work (preferably drawn up by a specialist design office due to the technical complexity),

- A technical intervention plan,

- An electrical connection diagram.

This does not require authorization from the general meeting (GM). However, the trustee must inform the co-owners at the next GM, which cannot oppose it, except in cases of force majeure or a serious and legitimate reason.

• In the second case, two steps are necessary:

1. In accordance with Article 24-5 of the 1965 law, amended by Article 69 of the law of 24 December 2019, the trustee is required to include on the agenda of the AGM the establishment of a detailed study, as part of a project to install electric terminals for all co-owners. A decision by a simple majority of those present and represented will suffice (Article 24).
2. After receiving several quotes, drawn up following this study, the AGM will decide, by an absolute majority of all co-owners (Article 25), on the advisability of undertaking this work and, if so, to designate the successful bidder, to set the frequency of the work and the amounts of the calls for funds to be distributed. Financial aid is possible in certain cases.

Since decree no. 2020-1720 of December 24, 2020, this concerns both open and closed parking lots, as long as they are private.
