The fiscal opinion complicated Javier Milei's case: the court considered his account in X to be presidential.

A fiscal opinion complicated the situation of President Javier Milei by considering that his account in X is not personal, but has an institutional character . The Justice approach was made by the federal prosecutor N.º 2 of La Plata, Oscar Julio Gutiérrez Eguía , within the framework of the complaint initiated by the family of Ian Moche , the young man with autism who was attacked on social networks after demonstrating against the adjustment in disability.
According to the prosecutor, the president's account has a gray mark , a symbol that X (formerly Twitter) grants exclusively to heads of state and high-ranking officials. The ruling states that the registered user is "Javier Milei," with the profile of "Economist," and that the account belongs to the current President of the Nation .
Moche family lawyer Andrés Gil Domínguez emphasized that this ruling has a direct impact on another key case: the investigation into the promotion of the cryptocurrency $Libra , a scam spread from the President's account.
In the legal proceedings initiated by IAN MOCHE against @JMilei , a judicial action took place that directly impacts the LIBRA case. Federal Prosecutor No. 2 of La Plata, Dr. Oscar Julio Gutiérrez Eguía, ruled that federal jurisdiction was enabled due to…

The government's defense had argued that the post about Libra had been made from a personal account and was not an institutional act. However, the prosecutor's report contradicts that version and reinforces the plaintiff's position.
"The ruling directly impacts the Libra case," warned Gil Domínguez. After hearing the document, federal judge Alberto Recondo upheld the prosecutor's position and established that the case should be heard in federal court. For the complaining family, this reinforces the idea that Milei's social media posts cannot be separated from his role as head of state.
The legal case arose from a post in which Milei accused young man Ian Moche of being linked to Kirchnerism and described him as someone who "is on the side of evil." The post generated a climate of digital harassment that included the dissemination of personal information such as his address and the name of his school.
The young man's mother, Marlene Spesso , repeatedly requested that the president remove the post. In the absence of a response, the family initiated legal action through a self-satisfying measure , requesting urgent judicial intervention.
"The grievance deepens with each passing day," the lawyer explained. To date, the post remains active on the President's official account. With the new prosecutor's ruling , the case could move forward and set a precedent for the institutional use of social media by public officials.
