Teachers didn't go en masse for overtime pay. Why?
Let us recall that at the end of February, the Supreme Court adopted a resolution on the basis of a case concerning a teacher who was the coordinator of a foreign exchange project for students at a high school. In her case, the additional work included preparing them for the trip, organizing the trip and coordinating contact between teachers from the host school. The woman devoted a lot of time to her duties, much more than is required by the regulations governing teachers' working hours. As a result, she filed a claim for payment of overtime. The courts of both instances partially upheld her claim and awarded her over PLN 18,500 in remuneration for overtime work with interest. The school filed a cassation appeal. The Supreme Court, in a panel of three judges, referred a legal question to the extended panel: "Has the issue of overtime work by teachers been exhaustively regulated in the Teachers' Charter, or should the provisions of Chapter V of Section Six of the Labor Code be applied accordingly - on the basis of Article 91c paragraph 1 of the Charter?"
