Municipal guards go to the Supreme Court against the law that created an elite division in Rio

The National Federation of Municipal Guard Workers' Unions, Fenaguardas, has filed a lawsuit with the Supreme Federal Court against part of the law that created an armed division in the Rio de Janeiro Municipal Guard. The rapporteur is Minister Edson Fachin, who has not yet ruled on the case.

On June 10, the City Council approved the creation of a special group within the GM that will be allowed to use firearms. The so-called Elite Division will be formed primarily by municipal guards, but will also be open to former members of the Armed Forces.

The law also allows the hiring of agents from the new division for one year, a period that may be extended up to five times, and establishes the position of trust of Municipal Public Security manager.

Mayor Eduardo Paes (PSD) sanctioned the text on June 13, without any vetoes.

For Fenaguardas, the rule violates the constitutional requirements for entry into public service , disregards criteria for occupying management positions, distorts the specific competencies of municipal guards and irregularly expands access to carrying firearms without legal support.

The entity requested that the STF reserve the special division for civil servants, eliminate the position of manager, prohibit temporary workers from carrying weapons and block hiring without a public competition for typical State functions.

He also requested that the Court establish the understanding that the activities of municipal guards must be carried out through positions created and filled by competition.

There is no set deadline for Fachin to comment on the demands.
