Marcin Mizi's tragic death. His parents shocked by what they hear in the courtroom
Who will be held responsible for the death of 28-year-old Marcin Mizi from Jastrzębie-Zdrój? What happened during the Sosnowiec Fun Festival in June 2024? With each hearing before the Family Court in Sosnowiec, questions multiply. The case already has 10 volumes of files, 15 witnesses have been heard.
The teenagers' defense attorneys told "Fakt" that it would be difficult to identify the perpetrators of Marcin Mizi's beating, because the surveillance footage only captured the crowd of people, and the attackers could not be identified. They claim that Marcin was attacked by other people. - The cameras recorded a lot of people. This is a crowd, something is happening in the second or third plane, and the image from the cameras is directed at the square, where there is an infinitely large group of people - the defense attorneys claim.
The tragedy occurred on June 9 last year. Marcin Mizia (†28 years old) was a footballer of the Spójnia Landek Sports Club. He worked as an officer of the Prison Service in Jastrzębie-Zdrój. He came to Sosnowiec with his fiancée for a Beata Kozidrak concert. During the concert, fights broke out.
Wiktor, Jakub and Dominik were in the crowd, they took part in the fights. The boys have been staying in shelters for minors since last year. Each of them has their own defense attorney. Behind the closed doors of the Family Court in Sosnowiec, the teenagers' trial is ongoing. They are suspected of beating 28-year-old Marcin Mizi to death. The young man died in hospital on June 12 as a result of his injuries.
According to media reports, Marcin Mizia died because he defended a 19-year-old from Czeladź who was attacked by teenagers. In retaliation, they allegedly attacked the young man and beat him up in front of the crowd and his fiancée.

Jacek Mizia emphasizes that Marcin died beaten by a horde of teenagers. The attack was witnessed by Marcin's fiancée, who tried to help him when the attackers were tormenting him. She was also injured. The teenagers' defense attorneys emphasize that there is no clear evidence that their clients beat an adult man to death.
Teen advocates: everything has been twisted by the media- According to media reports, Mr. Marcin was hit in the head with a bottle, he was kicked in the head, and this is not true. You did not verify this, witnesses testify differently. People taking part in the festival say something completely different, everything was twisted by the media - states Justyna Karwel, legal adviser, who is Wiktor's defense attorney.
– If the media had analyzed the situation thoroughly, they would have known that there were fights involving even several dozen people – Justyna Karwel told "Fakt". When the services arrived at the scene, the participants of the fights allegedly pointed to Wiktor, Jakub and Dominik as the perpetrators of the attack on Marcin Mizia. Why was the attack by the teenagers directed at the 28-year-old?
– I cannot say what could have started this incident – Wiktor's defense attorney tells "Fakt". – It does not follow from the proceedings that Marcin Mizia stood in defense of the 19-year-old – the defense attorney states. Then he adds: – There was definitely no bottle or kicking in the head of the lying Mr. Mizia – he says.

A short film has been circulating on the internet for months, showing what happened to Mr. Mizia. The film shows that Mr. Marcin falls by himself, hits a car standing next to him, and is not kicked by anyone – says Wiktor's defense attorney.
Justyna Karwel claims that the course of events was completely different than the media reports. – It didn't look like there were only three boys and no one else. There were a few fights, only two security guards. There was negligence on the part of the organizer, the event was poorly prepared and poorly monitored. Two security guards were busy dispersing the fighting groups. It's impossible for these two security guards to control the crowd or for anyone to catch what happened to Mr. Mizia on the cameras – she states.
The defendants' defense attorneys claim there is no evidence that they attacked Marcin Mizia.Wiktor allegedly took part in one of these fights. His defense attorney claims that he was not at the place where the attack on Marcin Mizia took place. – Wiktor definitely did not take part in this incident, at that time he was behind the deposit point and was being treated by a security guard, because in the first fight he was injured, his nose was broken and bloody. We sympathize with the family of Mr. Marcin for the loss of their son, but there is no clear evidence that minors are responsible for what happened – the defense attorney added in an interview with "Fakt".
A year ago, right after the incident, Wiktor's grandmother told "Fakt" that her grandson had told his relatives about the events during the Sosnowiec Days . He himself wanted to go to the police to give an explanation. During the Family Court session, Jakub and Dominik admitted that they had attacked Marcin Mizia. They emphasized that Wiktor had not participated in the incident. However, the court did not believe them and the three were taken to shelters in different parts of Poland so that they would not contact each other and establish a common version of events. The boys are still in the centers.
"It could have happened to any of us." Attorneys raise doubts- As of today, no one knows what happened there, despite the passage of time, the case is still developing. Evidence is being collected. In my opinion, there are no clear premises to attribute guilt to any of the people who are answering in the courtroom. My client did not escape. We do not know how many people took part in the attack on Mr. Mizia. It was them, there could have been many more people who attacked Marcin Mizia - adds attorney Dominik Kurczab, Jakub's defense attorney.
– There is no such thing in Polish law that a confession is the queen of evidence – he replied when asked by "Fakt" that his client had confessed in court.
- We must take into account that these are minors, under 18 years of age, in most cases they are having their first contact with the justice system and for the first time with an act typified in the penal code as a charge. Their explanations must be assessed through this prism - says Jakub's attorney.
– It was a coincidence of several circumstances. I cannot say why it was Mr. Mizia, it could have been any of us, any of the participants of this event – attorney Kurczab answers "Fakt". He adds that it would be necessary to look at the entire organization, preparation of the event and verify the time of arrival of the ambulance and the response of the services.
