Rodrigo Mattos: STJD denounces Bruno Henrique for manipulation; suspension is up to two years

Furthermore, the STJD prosecutor's office understood that there was a financial advantage for Bruno Henrique, albeit indirectly.

"Furthermore, the infraction was committed through the promise of economic advantage - although not directly for the athlete, but for the benefit of his brother and network of contacts - which reinforces the presence of the special subjective element required by the rule: the economically vitiated motivation of the conduct. Bruno Henrique was instigated by his brother to carry out the action (receiving a yellow card), with prior communication, to enable the placing of directed bets, which unequivocally characterizes a promise of future advantage for close third parties in total disharmony with sporting morality", says the complaint.

Regarding the second article, 243-A, the STJD prosecutor's office emphasized that the purpose of the manipulation was achieved with the card received by Bruno Henrique. Therefore, there is an aggravation in this case.

"Note that art. 243-A does not even require the materialization of the result, configuring, in fact, a special circumstance and an increase in the penalty provided for in the sole paragraph. In the case at hand, in fact, the card was effectively applied, and Bruno Henrique was suspended for the following match, which demonstrates that he faithfully complied with what was agreed, enabling the realization of directed bets based on this manipulation, which attracts the application of the aforementioned sole paragraph", says the text of the prosecutor's office.

The STJD also cites the articles of the Brazilian and General Competition regulations to explain that if Bruno Henrique is punished, the penalty should be extended globally. The CBF simply needs to notify other national federations.

In addition to Bruno Henrique, his brother Wander Pinto Junior, Claudinei Vitor Mosquete Bassan, Andryl Reis, and Douglas Barcelos were also charged with using information about the yellow card to place bets. They are registered as amateur athletes and are therefore also subject to prosecution by the Sports Court.
