The Supreme Court found the man at fault for not knowing his wife's workplace address, acting indifferently and not answering his wife's family's calls.

The Court of Cassation 2nd Civil Chamber found the husband at fault for not knowing his wife’s workplace address, acting indifferently and not answering his wife’s family’s calls, and approved the local court’s decision that ruled for alimony and compensation in the divorce case. According to the Chamber’s decision, a woman living in Antalya filed for divorce, stating that her husband did not show interest in her and her child, separated her bed, took her on unannounced trips, blocked her on social media and that she was ostracized and insulted by her husband’s family. The defendant husband did not even respond to the lawsuit, despite the fact that the petition was duly served on him. The Antalya 8th Family Court, which conducted the trial, found the man at fault for not even knowing where his wife’s office was, acting indifferently enough to ignore her and not answering the woman’s relatives’ calls, thus severing ties with her husband and family.

The court, finding that the couple’s “marriage was fundamentally shaken,” ruled that the parties divorce, that the child’s custody be given to the mother, that the man pay a monthly alimony of 1,000 lira for the child and 1,000 lira for the woman, and that the woman be paid 20,000 lira in material compensation. Upon the appeal of the decision, the 2nd Civil Chamber of the Antalya Regional Court of Justice found the local court’s decision lawful, but ruled that the material compensation to be paid to the woman be increased to 75,000 lira . Upon the man’s appeal, the file was brought to the Court of Cassation. The 2nd Civil Chamber of the Court of Cassation determined that the decision given by the first instance courts was in accordance with procedure and law. The Chamber rejected the defendant husband’s request and ruled that the verdict be upheld.
