Stanisław Gawłowski sentenced to 5 years in prison

Five years' imprisonment without parole – this was the sentence handed down to Civic Coalition senator Stanisław Gawłowski in a Szczecin court. The politician was convicted in a trial concerning the so-called land improvement scandal. The verdict is not final.
The senator, Secretary General of the Civic Platform from 2016 to 2018, faced seven charges, including corruption. Judge Grzegorz Kasicki acquitted him of one of them, concerning two luxury watches allegedly used by an employee of the Institute of Meteorology and Water Management to bribe Stanisław Gawłowski. Instead, he found the politician guilty of, among other things, accepting an apartment in Croatia as a bribe and committing plagiarism while writing his doctoral thesis.
Sentence: 5 years in prison. The senator was also banned from holding managerial positions in state institutions or state-owned companies for 10 years. He was also fined 180,000 złoty. The prosecutor had requested a 6.5-year prison sentence.
Stanisław Gawłowski maintains his innocence. In his closing argument, he recounted that he fell victim to political repression by the Law and Justice party and its subordinate services. According to him, he fell foul of the right wing when he refused to grant a geothermal subsidy to the Lux Veritatis Foundation, associated with Father Tadeusz Rydzyk. He also brought about the dismissal of Kazimierz Kujda from his position as president of the National Environmental Protection Fund, precisely because of his funding of the foundation. And Kazimierz Kujda, the senator emphasized, is Jarosław Kaczyński's "personal financier."
Stanisław Gawłowski's wife was sentenced to one year in prison, suspended for two years.
On Thursday, other defendants in the "land improvement scandal" were sentenced, bringing the total to 24. Judge Grzegorz Kasicki emphasized that the main defendant in this case was not the Civic Coalition senator, but Tomasz P. He was sentenced to 3.5 years in prison, suspended for 7 years.
Bogdan K., who was allegedly bribing Stanisław Gawłowski with real estate in Croatia, was sentenced to 3.5 years in prison.
The land improvement scandal encompasses 700 volumes of court records, including 500 substantive ones. Judge Grzegorz Kasicki admitted that, in terms of the volume of evidence, it was the largest case of his career.
"I dream that anyone who speaks out in this case—not in the sense of information, but in the sense of evaluating the evidence—will either at least briefly familiarize themselves with the evidence or wait for the court's reasoning, which will be relatively soon, because I have it well advanced," the judge said. He appealed to avoid "a situation where a politician will come out and say they know better what's in this case without reading it."
Grzegorz Kasicki also commented on the defense line of Stanisław Gawłowski and his lawyers, who said that the charges were brought for political reasons.
"I don't know the motivation behind the charges, and I'm not investigating. That doesn't interest me," the judge explained. "I'm interested in the charges. And the evidence. That's all. And not even the people." Themis, the symbol of the court, is depicted blindfolded. This blindfold signifies that everyone is to be equal before the court. The court should be concerned with the law and the evidence, not whether the accused is a politician or a carpenter, rich or poor, wise or foolish, young or old. None of that should matter. That's what the blindfold is for."
According to the judge, the politicization of this case served both sides of the Polish political dispute.

Grzegorz Kasicki also offered several criticisms of the prosecutor's office. For example, he stated that, technically speaking, Stanisław Gawłowski had almost nothing to do with the land improvement scandal—and yet it was the prosecutor who decided to connect the dots.
The written justification for the judge's decision is expected to be ready in the fall.
